摘要

中国虽然建立起了地理标志的保护制度，但对于地理标志的认识还十分欠缺，反映到制度上还存在着许多不完善的地方。笔者从地理标志概念入手，从认识上澄清了对地理标志内涵的片面理解，并且创新地提出了地理标志的性质及产权问题，指出了构建中国新型地理标志制度要从国情出发，通过对中国地理标志保护现状以及制度缺陷的分析，提出了构建新型地理标志制度的政策取向。

Abstract

The paper systematically introduces the basis of the construction of geographical indications system, the present condition of and defects in the protective system of Chinese geographical indications. At the end of the paper, it points out the construction orientation of new geographical indications system in our country. The paper is of rich conductive and consultative value for the research on the protective system of Chinese geographical indications.
